Terms of Service

Effective Date: February 16, 2026

This Terms of Service Agreement (“Agreement”) is entered into between HostAppy.com (the “Service”), provided by Lapalme Web Solutions (lwshost.com) (the “Provider”), and you, the end-user (“Customer” or “Client”).

By creating an account or using the Service, you agree to be bound by this Agreement. If you do not agree, you must not use the Service.


1. Description of Service

HostAppy.com provides managed hosting and deployment of open-source applications in a shared hosting environment. Applications are provisioned on shared infrastructure unless explicitly stated otherwise.


2. No Guarantee of Uptime

The Provider makes no guarantees regarding uptime, availability, performance, or uninterrupted access to the Service.

The Service may be unavailable from time to time due to maintenance, hardware failure, software issues, security incidents, third-party outages, or other causes beyond our control. The Client acknowledges and accepts these risks.


3. Shared Environment

Applications are deployed in a shared infrastructure environment. While reasonable measures are taken to isolate accounts, Clients understand that shared hosting carries inherent technical limitations and risks.


4. Ownership of Content

All content, data, files, and materials uploaded, generated, stored, or processed within a Client’s hosted application instance (“User-Generated Content”) remain the sole property and responsibility of the Client.

The Provider claims no ownership rights over Client content. However, the Client is fully responsible for the legality, integrity, and accuracy of all such content.


5. Backups and Data Loss

Clients are solely responsible for maintaining backups of their data. Clients must implement their own backup procedures or obtain third-party backup services.

The Provider shall not be liable for any data loss, corruption, deletion, hardware failure, software malfunction, security breach, or any other event that results in partial or total loss of Client data.

Use of the Service is at the Client’s own risk.

The Client is solely responsible for ensuring that their use of the Service complies with all applicable laws.


7. Monitoring and Investigation

The Provider reserves the right to examine, review, or access hosted content if a complaint is received or if there is reasonable suspicion of a violation of this Agreement or applicable law.

Access to content will be limited to what is reasonably necessary to investigate the issue and protect the Service, other users, or comply with legal obligations.


8. Suspension and Termination

The Provider reserves the right, at its sole discretion, to suspend, restrict, delete content, or terminate accounts at any time, with or without notice, for violations of this Agreement or for any activity deemed harmful, unlawful, or disruptive to the Service.

Termination does not relieve the Client of responsibility for outstanding fees or liabilities incurred prior to termination.


9. Limitation of Liability

To the maximum extent permitted by law, the Provider shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of the Service.

The Provider may modify these Terms of Service at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

This Agreement shall be governed by and interpreted in accordance with the laws of Canada and applicable provincial laws, without regard to conflict of law principles.
